Technical Services Terms & Conditions

The following terms and conditions are applicable to the services proposed and must be agreed upon unless arrangements are made in advance with ETS Solutions.

1. PRICING, TAXING AND FEES

The contracted rate for the technical service such as repair/maintenance/calibration/system health check is as based on the official quotation. The price includes only the job stated. Any additional job outside the scope will be charged separately. ETS Solutions warrants the prices quoted are complete and accurate at the time of the quotation and will remain valid for the period of 60 days or otherwise stated. All prices are exclusive of all local (point of use) sales taxes or licenses, inspections, insurance’s or other fees. This includes all forwarding agent fees.

For testing or calibration of sensors or other equipment and accessories, ETS will charge the minimum fee mentioned below if the parts are found to be faulty before the laboratory carry out the testing or calibration.

  • Testing $500

  • Calibration $150

2. PRE-REQUIREMENT

It must be implicitly understood by the customer and ETS Solutions that the equipment under the Technical Service Contract is in an acceptable condition other than the work to be carried at the time of quotation. Acceptable condition explicitly means the machine state of condition outside the Technical Service Contract is in good working order and that it is not damaged or malfunctioning or in want of repair and/or service of one kind or another.

3. SCOPE OF WORK

ONLY AND UNLESS REQUESTED by an authorized representative of the Customer (either in writing or verbally) will ETS Solutions repair and/or service, replace parts. Such services rendered (exceeded the scope of work sited in the Technical Service Contract) will be negotiated separately and subjected to the prices prevailing and currently charged by ETS Solutions Asia Pte Ltd. Payment will be in accordance to invoice terms.

4. SERVICE HOURS

ETS Solutions will during normal working hours (currently 9.00am to 5.00pm Monday to Friday excluding general and local public holidays) perform the technical services with respect to the work order.

5. FIELD SERVICE / CALBRATION / PREVENTIVE MAINTENANCE / TESTING REPORT

A technical report will be submitted to the customer upon completion of technical services, including service rendered outside this Agreement if applicable. This report is applicable for non-warranty contract only. This Report is issued under the following conditions:

i. Results of the testing/calibration in the form of a report will be issued immediately after the service has been completed.

ii. Unless otherwise requested, a report shall contain only technical results. Analysis and interpretation of the results and professional opinion and recommendations expressed their upon, if required, shall be clearly indicated and additional fee paid for, by the Client.

iii. This report applies to the specific product/equipment given at the time of its testing/calibration. The results are not used to indicate or imply that they are applicable to other similar items. In addition, such results must not be used to indicate or imply that ETS Solutions approves, recommends or endorses the manufacturer, supplier or user of such product/equipment, or that ETS Solutions in any way “guarantees” the later performance of the product/equipment.

iv. Additional copies of the report are available to the Client at an additional fee. No third party can obtain a copy of this report through ETS Solutions, unless the Client has authorised ETS SOLUTIONS in writing to do so.

v. ETS SOLUTIONS may at its sole discretion add to or amend the conditions of the report at the time of issue of the report and such report and such additions or amendments shall be binding on the Client.

vi. All copyright in the report shall remain with ETS SOLUTIONS and the Client shall, upon payment of ETS Solutions fees for the carrying out of the tests/calibrations, be granted a license to use or publish the report to the third parties subject to the terms and conditions herein, provided always that ETS SOLUTIONS may at its absolute discretion be entitled to impose such conditions on the license as it sees fit.

vii. This report shall not be reproduced or modified wholly or in parts without notice and permission from ETS Solutions.

6. LIMITED WARRANTY

ETS Solutions will be responsible for direct physical damage, injury or loss caused by the negligence of ETS Solutions. However, in no circumstances will ETS Solutions be responsible for any loss of business or profit or for any other consequential loss arising including delay in or failure to provide maintenance.

7. PAYMENT

Funds quoted as per currency indicated in the first page of this quotation. Payment is by T/T Wire Transfer unless stated otherwise. Payment is due per date stated in the invoice.

8. PARTS REPLACEMENT

ETS Solutions shall have the right to substitute goods or equivalent, as and when they see it is appropriate so as to carry out the delivery smoothly or timely.

9. DELAY IN SUPPLY AND DELIVERY

In the event of failure by ETS Solutions to supply and deliver any items or complete the service by the date specified due to the following s circumstances, namely, acts of god, arrests and restraints of princes, ruler or people, force majeure, riots and civil commotion, strikes, lock outs or other labour disturbances, fire, war, perils or sea, delay in transit and others causes or perils beyond ETS Solutions control then in any such circumstances aforesaid, be relieved of his obligation to supply and deliver any such stores thereby affected.

10. WARRANTY (not applicable for non-warranty)

During the warranty period after equipment is installed, the parts are warranty against any defect causes by malfunction or defect arising out from the design. Warranty does not cover malfunction that is cause by the negligence of the operator or to meet your changing specification
